2. collection and storage of personal data as well as type and purpose of their use

a) When visiting the website

When you visit our website www.lavita-swiss.ch, information is automatically sent to the server of our website by the browser used on your end device. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the accessed file,
  • website from which the access was made (referrer URL),
  • browser used and, if applicable, the operating system of your computer as well as your screen resolution.

The aforementioned data is processed by us for the following purposes:

  • Ensuring a smooth connection setup of the website,
  • Ensuring a comfortable use of our website,
  • evaluation of system security and stability as well as
  • for other administrative purposes.

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person. In addition, we use cookies and analysis services when you visit our website. b) When ordering in the online store as a guest

If you wish to order products via our website as a guest, we collect the following information:

  • Salutation, first name, last name,
  • a valid e-mail address,
  • address,
  • payment data, depending on the payment method you have selected (for example, bank details or Paypal account data).

The collection of this data is done,

  • to be able to identify you as our contractual partner;
  • to check the entered data for plausibility;
  • for the payment processing of your order;
  • for the processing of any warranty claims and the assertion of any claims against you;

The data processing is carried out in response to your request and is necessary for the aforementioned purposes for the fulfillment of the contract and pre-contractual measures in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO.

In order to ensure a smooth and easy processing of your order and for faster clarification of any queries, you can also provide additional data:

  • Your telephone number and
  • an alternative delivery address.

The provision of this data is voluntary.

The personal data collected by us for the order will be stored until the expiry of the statutory warranty obligation and then automatically deleted, unless we are obliged to store it for a longer period of time pursuant to Article 6 (1) sentence 1 lit. c DSGVO due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to storage beyond this pursuant to Article 6 (1) sentence 1 lit. a DSGVO.

c) When setting up a user account

You have the option of setting up a password-protected user account with us, in which we store your personal data. This serves the purpose of providing you with the greatest possible convenience in the processing of your orders through easier, faster and more personalized purchase processing.

If you wish to set up a password-protected user account with us, we require the following information from you:

  • Salutation, first name, last name,
  • address and
  • a valid e-mail address.

In addition, you must provide a password of your choice to set up a user account. Together with your e-mail address, this enables you to access your user account. In your user account, you can view and change the data stored about you at any time.

We only store your personal data in a user account if you have voluntarily given us your consent to do so in accordance with Art. 6 (1) p. 1 lit. a DSGVO.

The creation of a user account is not required for the use of our site or for orders that you wish to place with us. We offer you the option to place your order as a guest (see under point 2. b). In this case, however, you will have to re-enter your data in full each time you place an order.

After deletion of your user account, your data will be automatically deleted for further use, unless we are obliged to store it for a longer period of time according to Article 6 para. 1 p. 1 lit. c DSGVO due to tax and commercial law retention and documentation obligations (from HGB, StGB or AO) or you have consented to the storage beyond this according to Article 6 para. 1 p. 1 lit. a DSGVO.

d) When registering for our newsletter

If you have expressly consented in accordance with Art. 6 (1) p. 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to enter an e-mail address in the newsletter form on the home page.

We may also use your e-mail address to send you information about similar products of our company, provided that you are our existing customer and have not objected to the use of your e-mail address.

In both cases, you can unsubscribe at any time, e.g. via a link at the end of each newsletter. Alternatively, you can also send your unsubscribe request at any time by e-mail to info@lavita-swiss.ch.

If we send you e-mail newsletters, these newsletters contain elements that react to the reading or confirmation of links within the newsletter and are associated with an individual technical identification. We use this information for a statistical evaluation of all feedback obtained from the use of the newsletter in order to improve the newsletter service for you. For newsletter campaign automation, we use the services of Exponea (see 5. a) VII.).

e) When using our contact form

For questions of any kind, we offer you the opportunity to contact us via a form provided on the website. In doing so, it is necessary to provide a valid e-mail address so that we know from whom the inquiry originates and so that we can answer it. Further information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO on the basis of your voluntarily given consent.

The personal data collected by us for the use of the contact form will be automatically deleted after completion of your request.

f) For applications using the online form

You have the option of sending us an unsolicited application within the framework of the online application form. As part of the application process, the following personal data will be collected from you and stored:

  • Salutation
  • First and last name
  • e-mail address
  • job title
  • start date
  • Salary requirements
  • Div. attachments (e.g. letter of application, photo, certificates)

In addition, you also have the option of voluntarily providing us with your telephone number and a text for further information.

Data processing is carried out upon your request and only insofar as it is necessary in the context of responding to the application and establishing the employment relationship pursuant to Art. 88 Para. 1 DSGVO in conjunction with. § 26 para. 1 BDSG or to protect our legitimate interests pursuant to Art. 6 para. 1 p. 1 lit. f DSGVO.

The data is processed for the purpose of applying for employment. Personal data is regularly deleted 6 months after the end of the application process, unless you have consented to longer retention pursuant to Art. 6 para. 1 p. 1 lit. a DSGVO.

3. transfer of data

Your personal data will not be transferred to third parties for purposes other than those listed below.

a) For contract processing

Insofar as this is legally permissible and is required in accordance with Art. 6 (1) p. 1 lit. b DSGVO for the processing of contractual relationships with you, your personal data will be passed on to third parties. This includes in particular the disclosure to shipping companies for the purpose of delivery of the goods ordered by you and the disclosure of payment data to payment service providers or credit institutions to carry out a payment transaction. The data passed on may be used by the third party exclusively for the purposes stated.

b) For billing purposes

Based on our legitimate interests according to Art. 6 para. 1 p. 1 lit. f DSGVO, we may also transmit your data to our partners. The transfer of your data to our partners is necessary for general billing purposes. This economic interest is to be regarded as a legitimate interest within the meaning of Art. 6 (1) p. 1 lit. f DSGVO.

c) For other purposes

In addition, we will only disclose your personal data to third parties if:

  • you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO,
  • the disclosure is necessary for the assertion, exercise or defense of legal claims pursuant to Art. 6 (1) sentence 1 lit. f DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data, as well as
  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 (1) sentence 1 lit. c DSGVO.

4. cookies

We use cookies on our site. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your end device, do not contain viruses, Trojans or other malware.

In the cookie, information is stored that arises in each case in connection with the specific end device used. This does not mean, however, that we gain direct knowledge of your identity.

The use of cookies serves on the one hand to make the use of our offer more pleasant for you. a) Tracking tools

The tracking measures listed below and used by us are carried out on the basis of Art. 6 (1) p. 1 lit. f DSGVO. With the tracking measures used, we want to ensure a needs-based design and continuous optimization of our website. On the other hand, we use the tracking measures to statistically record the use of our website and evaluate it for the purpose of optimizing our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

I.) Google Analytics

For the purpose of demand-oriented design and ongoing optimization of our pages, we use Google Analytics, a web analytics service provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). In this context, pseudonymized usage profiles are created and cookies (see under section 4) are used. The information generated by the cookie about your use of this website such as

  • Browser type/version,
  • operating system used,
  • Referrer URL (the previously visited page),
  • host name of the accessing computer (IP address),
  • time of the server request,

are transmitted to a Google server in the USA and stored there. The information is used to evaluate the use of the website, to compile reports on website activity and to provide other services related to website and internet use for the purposes of market research and demand-oriented design of these Internet pages. This information may also be transferred to third parties if this is required by law or if third parties process this data on our behalf. Under no circumstances will your IP address be merged with other Google data. The IP addresses are anonymized so that an assignment is not possible (IP masking).

You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on.

II.) Google Adwords Conversion Tracking

In order to statistically record the use of our website and to evaluate it for the purpose of optimizing our offer for you, we also use Google Conversion Tracking. In this process, Google Adwords sets a cookie (see section 4) on your computer if you have accessed our website via a Google ad.

These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords customer's website and the cookie has not yet expired, Google and the customer can recognize that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. Cookies can therefore not be tracked across Adwords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. The Adwords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in the tracking process, you can also refuse the setting of a cookie required for this - for example, via a browser setting that generally disables the automatic setting of cookies. III.) Google Tag Manager

Google Tag Manager is a solution that allows us to manage so-called website tags via an interface (and thus, for example, integrate Google Analytics as well as other Google marketing services into our online offering). The Tag Manager itself (which implements the tags) does not process any personal data of the users. IV.) Bing Ads

We use Bing Universal Event Tracking (UET) from Microsoft Bing Ads. This is a service provided by Microsoft Corporation ("Microsoft"). It allows us to track the activity of users on our website when they reach our website through ads from Bing Ads.

If you arrive at our website via a Bing Ads ad, a cookie (see section 4) is set on your computer. A Bing UET tag is integrated on our website. This is a code that is used in conjunction with the cookie to store some non-personal data about the use of the website. This includes, among other things, the length of time spent on the website, which areas of the website were accessed and via which ad the users arrived at the website. Information about your identity is not collected.

This information is transferred to Microsoft servers in the USA and stored there for a maximum of 180 days.

V.) Bloomreach/Eponea

For interest-based marketing purposes, retargeting, optimization of our website, analysis of your browsing behavior and marketing campaign automation, this website uses the services of Exponea DE GmbH, Kemperplatz 1, Mitte D, 10785 Berlin.

V.) OpenReplay

OpenReplay is an open source session replay software that we use to analyze how users use our platform. OpenReplay provides us with records for this purpose, which we can use to track activity on the platform in the event of a problem ("bugs") and thus fix them. OpenReplay is configured so that all data entered for recording is anonymized and made unrecognizable. Through this anonymization, only the pure history or the procedure of the user and the occurrence of bugs are recorded and documented. Any personal data is automatically anonymized and made unrecognizable. Furthermore, OpenReplay does not store any personal data.

b) Targeting and remarketing tools

The targeting measures listed below and used by us are carried out on the basis of Art. 6 (1) p. 1 lit. f DSGVO. By means of the targeting measures used, we want to ensure that you are only shown advertising on your end devices that is oriented to your actual or presumed interests. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

We also use remarketing on our website. This is a procedure with which we would like to address you again. Through this application, our advertisements can be displayed to you during your further internet use after visiting our website. This is done by means of cookies stored in your browser, which are used to record and evaluate your usage behavior when visiting various websites via tracking partners. In this way, the tracking partners can determine your previous visit to our website. The tracking partners do not combine the data collected in the course of remarketing with your personal data that is stored. In particular, pseudonymization is used by the tracking partners during remarketing.

I.) Google Adwords Remarketing

We use Google remarketing tags. These are services provided by Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter "Google"). Google uses cookies (see section 4), which are stored on your computer and which enable an analysis of your use of the website. The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored by Google on servers in the United States. The IP address is then shortened by Google by the last three digits, a clear assignment of the IP address is therefore no longer possible. II.) Facebook Retargeting / Remarketing

Remarketing tags of the social network Facebook, 1601 South California Avenue, Palo Alto, CA 94304, USA ("Facebook") are integrated on our pages. When you visit our pages, the remarketing tags establish a direct connection between your browser and the Facebook server. Facebook thereby receives the information that you have visited our site with your IP address. This allows Facebook to associate the visit to our pages with your user account. We can use the information obtained in this way to display Facebook Ads.

We would like to point out that we, as the provider of the pages, have no knowledge of the content of the transmitted data or its use by Facebook.

III.) Facebook Custom Audiences

In addition, we also use Facebook Website Custom Audiences. This is a marketing service provided by Facebook. This allows us to display individually tailored and interest-based advertising on Facebook to certain groups of pseudonymized visitors to our website who also use Facebook.

A Facebook Custom Audience pixel is integrated on our website. This is a Java script code via which non-personal data about the use of the website is stored. This includes your IP address, the browser used and the source and target pages. This information is transferred to Facebook servers in the USA. There, it is automatically compared whether you have saved a Facebook cookie. The Facebook cookie is used to automatically determine whether you belong to the target group relevant to us. If you belong to the target group, you will be shown corresponding ads from us on Facebook. IV.) TikTok

We use the TikTok Pixel on our website. The TikTok Pixel is a TikTok advertiser tool provided by TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland, and TikTok Information Technologies UK Limited, WeWork, 125 Kingsway, London, WC2B 6NH, United Kingdom (collectively, "TikTok").

The TikTok Pixel is a JavaScript code snippet that allows us to understand and track visitors' activity on our website. For this purpose, the Tiktok Pixel collects and processes information about the users of our website or the devices they use. The data collected through the TikTok Pixel is used for targeting our ads and improving ad delivery and personalized advertising. For this purpose, the data collected on our website by means of the TikTok Pixel is transmitted to TikTok. In part, this data is information stored in the terminal device you are using. 6. social media plug-ins

We use social plug-ins of the social networks Facebook, Twitter and Instagram on our website on the basis of Art. 6 (1) p. 1 lit. f DSGVO in order to make our company better known through them. The underlying promotional purpose is to be regarded as a legitimate interest within the meaning of the DSGVO. The responsibility for data protection-compliant operation is to be ensured by their respective providers. The integration of these plug-ins by us takes place by way of the so-called two-click method in order to protect visitors to our website as best as possible.

a) Facebook

Social media plug-ins from Facebook are used on our platform to make their use more personal. For this purpose, we use the "LIKE" or "SHARE" button. This is an offer from Facebook.

When you call up a page of our website that contains such a plugin, your browser establishes a direct connection with Facebook's servers. The content of the plugin is transmitted by Facebook directly to your browser, which then integrates it into the website.

By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

You have the right

  • In accordance with Art. 15 DSGVO, to request information about your personal data processed by us.   • pursuant to Art. 17 DSGVO, to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defense of legal claims;
  • pursuant to Art. 18 DSGVO, to request the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defense of legal claims or you have objected to the processing pursuant to Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO, to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller;
